The meeting was called to order at 7:10pm by Mayor Butrico in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-6, with adequate notice of this meeting of the Borough Council being provided to the borough’s two official newspapers and also published on the Borough’s website. 

Clerk Graf called the roll.  Present were Council Members: Bengivenga, Buteas, McConville, Rusnak, and Anesh.  Mr. Salerno was excused.

Mr. Bengivenga made a motion to accept the minutes of June 7, 2010 Agenda, Public and Executive meetings; seconded by Mr. Rusnak.

The Mayor opened the meeting to the Public for comments on Agenda items only.

No comments.

Mayor Butrico closed the public portion and called for Ordinance # 1893.

Clerk Graf read Ordinance # 1893 by title only for public hearing and final adoption:

#1893 entitled:  An ordinance amending the Code of the Borough of South Plainfield to

   provide for procedures for speed hump requests and evaluations.

As this is a final reading, Mayor Butrico opened the public hearing on Ordinance # 1893.

There were public comments so Mayor Butrico closed the Public Hearing and called for a motion.

Mr. Bengivenga made a motion to adopt Ordinance # 1893; seconded by Mr. Anesh as follows

BE IT ORDAINED by the Mayor and Council of the Borough of South Plainfield, County of Middlesex State of New Jersey, that the Code of the Borough, Chapter 409, Streets and Sidewalks, be amended to Article VI entitled Speed Hump Requests and Evaluation Procedures as follows:

SECTION 409-51 – OVERVIEW.

            The purpose of this policy is to provide guidance and objectivity in the evaluation and selection of roadways for the installation of speed humps.  Prior to the approval and installation of speed humps, the Borough shall authorize a traffic study of the impacted area.  Where appropriate, other temporary traffic calming measures should be considered and/or implemented prior to the installation of speed humps.

            A speed hump shall be defined as a raised area of pavement intended to control vehicular speed in conformity with New Jersey law, Title 39 of the Revised Statutes and New Jersey Department of Transportation and the design specifications therein including the engineering specifications for maximum height, profile and minimum and maximum length.  Speed humps include speed tables, cushions and lumps.

            Requests for speed humps shall be in writing or submitted to an available Borough website form to the attention of the Borough Clerk.  The Borough Clerk shall provide a copy of the request to the Traffic Safety Division of the Police Department, the Chief of Police and the Chairman of the Public Safety Committee.  The general nature of the concern causing the request shall be stated.  Such reasons may be included, but are not limited to, excessive speeding or “cut

through traffic”.  Speed hump request evaluations will be handled in the order in which they are received.  Requests for speed humps that do not meet the minimum requirements as established by New Jersey Statute shall be rejected, but the area affected may be considered for other traffic calming devices.  Streets approved for installation of speed humps shall be placed on an approved list subject to funding and Council approval.

SECTION 409-52 – ELIGIBILITY REQUIREMENTS.

            A request will only qualify for consideration if the following criteria are met:

1.                   The roadway must be a Borough owned and maintained street.

2.                   A resident petition must describe the conditions to be remediated.  The Petition should include resident signatures supporting the application.

3.                   70% of the households listed within the project area must support the installation of speed humps.  The Borough Engineer shall determine the project or impact area.

4.                   The roadway must be a two-lane residential or one-way residential street with a posted speed limit of 30 mph or less.

5.                   The street must be in reasonably good condition as determined by the Borough Engineer in his or her sole discretion or be incorporated as part of a roadway resurfacing project.

6.                   Dead end streets and cul-de-sacs shall not be considered for speed humps.

SECTION 409-53 – EVALUATION.

All requests that meet the initial eligibility criteria will be formally evaluated as listed below:

1.                   After determination of the impact or project area as defined by the Borough Engineer, the applicant shall provide notice to all residents within such area advising of the request and the right of any resident to object by providing written notice of objection to the attention of the Borough Clerk within ten days of the receipt of notice of the request.  Notice to residents shall be by certified mail, return receipt requested.  Applicants must submit proof of notice by providing the Borough Clerk with receipts from each resident within the impact or project area, or proof of mailing and failure of a resident to accept notice.

2.                   Formal traffic study by the Traffic Safety Unit of the South Plainfield Police Department.

3.                   Determination of the 85th percentile speed as determined by a speed survey over a minimum 24-hour period.

4.                   Daily traffic counts as determined by a traffic study exceed 350 vehicles per day, but not to exceed 3,000 vehicles per day.

5.                   After the evaluation of the Traffic Safety Unit, the request shall proceed to the Chief of Police, EMS and Fire Department.  The Chiefs shall provide written comments that will be attached to the request, and will be made available to the Borough Traffic Safety Advisory Committee to consider in their assessment.

6.                   Upon the completion of the Traffic Safety Unit’s evaluation and the comment phase by the Chiefs of Police, EMS and Fire Department, the Borough Traffic Safety Advisory Committee shall review the request and study and provide written comments to the Public Safety Committee of the Borough Council.

7.                   Concerns raised by the Chiefs of Police, EMS and Fire Department, as well as those raised by the Traffic Safety Advisory Committee will be presented to the Public Safety Committee.

8.                   Requests approved by a majority of the Public Safety Committee will be presented to the Borough Council for approval.

9.                   After the Council has had sufficient time to review the request and comments, the Council shall vote on the request.  If the request receives approval of the Council, it shall pass to the prioritization phase.

SECTION 409-54 – PRIORITIZATION.

            The installation of speed humps will be prioritized on a Borough-wide basis.   Projects shall be prioritized based upon the following factors as a result of the formal evaluation:

1.                   Date of approved evaluation.

2.                   Comparison of the operating speed or the 85th percentile speed to the statutory speed limit.

3.                   Daily traffic count average.

4.                   Accident history.

5.                   Proximity to schools, parks, playgrounds or other facilities with high numbers of children, bicycle or pedestrian use.

Lower prioritized, but less costly projects may be implemented ahead of higher prioritized items if funding levels do not allow the installation of higher prioritized projects.

SECTION 409-55 – DESIGN AND CONSTRUCTION.

            Speed hump layout and design will be determined by the Borough Engineer.  All construction shall conform to the New Jersey Department of Transportation technical standards in place at the time of installation.  Generally, speed humps should have a maximum profile of three inches with a maximum twenty-two foot long base.   The distance between speed humps shall be at the discretion of the Borough Engineer, and within the requirements of the NJDOT.  All signage and pavement markings shall conform to the Manual of Uniform Traffic Control Devices for streets and Highways.

SECTION 409-56 – SPEED HUMP REMOVAL.

            The process for request to remove speed humps will follow the same procedure used to evaluate the installation of speed humps.  Absent any design faults or unforeseen issues that result in unsafe conditions, the cost of removal shall be borne by the property owners via local assessment.  In the case of design fault or unforeseen issues, the Borough will bear the full responsibility of the cost of removal.

SECTION 409-57 – TEMPORARY SPEED HUMPS.

The Borough Council may authorize the installation of temporary speed humps without following the aforementioned policy.

This Ordinance shall take effect upon final passage and publication in accordance with New Jersey law.

   waiving fees for disabled persons seeking to make their homes handicapped

   accessible

There were public comments so Mayor Butrico closed the Public Hearing and called for a

motion.

Mr. Anesh made a motion to adopt Ordinance # 1894; seconded by Mr. Bengivenga as follows:

BE IT ORDAINED by the Mayor and Council of the Borough of South Plainfield, County of Middlesex, State of New Jersey, that Ordinance 1801 entitled, “An Ordinance Establishing A State Uniform Construction Code Enforcing Agency, Etc.” is hereby amended by waiving construction fees for disabled persons seeking to make their homes handicapped accessible.  The amendment shall read as follows:

13. Exemption from Construction Fees.

Pursuant to the provisions of N.JS.A.. 52:27D-126(e), no person shall be charged a construction permit surcharge or enforcing agency fee, except those fees for subcode inspections not performed by Borough employees, for any construction, reconstruction, alteration, or home improvement designed and undertaken solely to promote accessibility by disabled persons to an existing public or private structure, or any of the facilities contained therein.

A disabled person as defined herein, or a parent or sibling of a disabled person, shall not be required to pay any municipal fee or charge in order to secure a construction permit for any construction, reconstruction, alteration or improvement which promotes accessibility to his or her own living unit.

For the purposes of this section, “disabled person” means a person who has the total and permanent inability to engage in any substantial gainful activity by reason of any medically determinable physical or mental impairment, including blindness, and shall include, but not be limited to, any person who is disabled pursuant to the federal Social Security Act (42 USC §416), or the federal Railroad Retirement Act of 1974 (45 USC §231 et seq.), or is rated as having a 60 percent disability or higher pursuant to any federal law administered by the United States Veterans Administration. For purposes of this paragraph "blindness" means central visual acuity of 20/200 or less in the better eye with the use of correcting lenses. An eye which is accompanied by a limitation in the field of vision such that the widest diameter of the visual field subtends an angle no greater than 20 degrees shall be considered as having a central visual acuity of 20/200 or less.

     All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed.

This Ordinance shall take effect upon final passage and publication in accordance with New Jersey law.

Mr. Bengivenga made a motion to approve Resolutions 10-160 through 10-169; seconded by Mr. Rusnak which all begin with BE IT RESOLVED BY THE GOVERNING BODY OF THE BOROUGH OF SOUTH PLAINFIELD, NEW JERSEY, THAT:

WHEREAS, a need has been determined for School Crossing Guard services for the 2010 – 2011 school year; and

WHEREAS, sealed bids for School Crossing Guard Services were received and publicly opened on July 21, 2009; and

WHEREAS, DMS Systems, Inc., 50 Lewis Avenue, Jersey City, New Jersey 07306. was determined to be the lowest qualified bidder, at a cost of $14.99 per guard per hour and a one year agreement was executed for the period July 1, 2009 through June 30, 2010;  and

WHEREAS, in accordance with the Local Public Contracts Law, N.J.S.A. 40A: 11-15, said    agreement may be extended for two (2) one-year terms; and

WHEREAS, said contract was renewed from July 1, 2009 through June 30, 2010 by approval of Resolution #09-212.

WHEREAS, the Borough of South Plainfield and DMS Systems mutually agree to renew the contract agreement  for one additional one year period at the same cost hourly rate of $14.99; and

WHEREAS, the Borough reserves the right to adjust locations and/or personnel as needed; and

WHEREAS, funds for said purpose will be made available in the CY 2010 budget.

NOW THEREFORE BE IT RESOLVED by the Governing Body of the Borough of South Plainfield that authorization is hereby given to renew a contract for School Crossing Guard services for the Borough of South Plainfield to DMS Systems, Inc., 50 Lewis Avenue, Jersey City, New Jersey 07306. at an hourly rate of $14.99 per guard per hour, and a total cost not to exceed $372,000.00  for the period July 1, 2010 through June 30, 2011.

FURTHER BE IT RESOLVED that the Mayor and Municipal Clerk are hereby authorized to execute the necessary agreement with DMS Systems, Inc.

WHEREAS, funding is needed in support of the Labor Day parade organized and operated by the South Plainfield Public Celebrations Committee; and

WHEREAS, the Boyle Memorial Foundation and Oldtimers Motorcycle Club have volunteered to operate a raffle in which the first prize will be 25% of all funds collected; second prize will be 15% of all funds collected; and third prize will be 10% of all funds collected, and the remaining 50% of funds will be donated to the South Plainfield Public Celebrations Committee; and

WHEREAS, the Boyle Memorial Foundation has an application pending for a State identification number for use for raffles, and does not anticipate receipt of the number in sufficient time to operate the raffle; and

WHEREAS, the Open Your Heart for Children Battling Cancer Foundation, Inc. has offered to allow use of its identification numbers to support the raffle; and

WHEREAS, numerous communications, including conference calls, have been held among Councilwoman Chrissy Buteas, Borough Attorney Paul R. Rizzo, Toni Moretti of Moretti Realty

and a representative of Open Your Heart for Children Battling Cancer Foundation, Inc., and Ms. Deborah Boyle of the Boyle Memorial Foundation; and

WHEREAS, agreement has been reached as to the proper wording for the raffle ticket, and Boyle Memorial Foundation and Oldtimers Motorcycle club have volunteered to issue tickets and accept funds, and will open a separate bank account for such raffle; and

WHEREAS, Open Your Heart for Children Battling Cancer Foundation, Inc. is a deserving charity performing needed services for children with cancer, and has voluntarily agreed to assist the Borough of South Plainfield by allowing its State identification number to be utilized for the raffle

NOW, THEREFORE, be it resolved by the Governing Body of the Borough of South Plainfield, County of Middlesex, State of New Jersey that the South Plainfield Public Celebrations Committee is authorized to accept funds from the Boyle Memorial Foundation and Oldtimers Motorcycle Club received as a result of the raffle, the drawing to be held on Labor Day, September 6, 2010; and

BE IT FURTHER RESOLVED that upon receipt of such funds, the Borough of South Plainfield shall make a donation to the Open Your Heart for Children Battling Cancer Foundation, Inc. in an amount to be determined.

WHEREAS a need exists to employ a seasonal workforce at the South Plainfield Summer Parks program during the summer months from June 28 to July 31, 2010; and

WHEREAS, the Recreation Director has recommended the hiring of the individuals listed on Appendix A at the rates of pay indicated which are consistent with the current salary ordinance.

NOW THEREFORE BE IT RESOLVED that the individuals so named on the Appendix A be employed as seasonal employees in South Plainfield Summer Parks program during the summer months from June 28 to July 31, 2010 at a rate of pay as indicated

WHEREAS, N.J.S.A. 40a:4-19 Local Budget Act provides that where any contracts, commitments or payments are to be made prior to the final adoption of the budget, temporary appropriations should be made for the purposes and amounts required in the manner and time therein provided, and

WHEREAS, the date of this resolution is prior to the adoption of the CY 2010 Budget, and

WHEREAS, the temporary budget set forth below does not exceed twenty six and one quarter percent of the total appropriations in the previous years budget (exclusive of any appropriations made for Debt Service, Capital Improvements Fund and Public Assistance).

NOW THEREFORE BE IT RESOLVED by the Governing Body of the Borough of South Plainfield that the temporary appropriations are hereby amended to add the following amounts and that a certified copy of this resolution be transmitted to the Chief Financial Officer.

WHEREAS, Borough Assessor Gary Toth will retire his position as Assessor on July 1, 2010; and

WHEREAS, Chief Assistant Assessor Margaret Ackerman has agreed to assume the position of Borough Assessor effective July 1, 2010;

NOW, THEREFORE, it is hereby resolved by the Borough Council of the Borough of South Plainfield that Margaret Ackerman is hereby promoted to the position of Borough Assessor effective July 1, 2010 at a salary commensurate with the Borough Salary Ordinance.

WHEREAS, with the retirement of Borough Assessor Gary Toth, the Assessing Department will make several adjustments in staffing to insure a smooth transition and continued effective performance; and  

WHEREAS, the Assessing Dept. is in need of a Senior Assessing Clerk to assist the new Borough Assessor ; and

WHEREAS, John Calvey has accepted a transfer from his position as Fire Inspector to that of Senior Assessing Clerk, effective July 1, 2010; and

NOW, THEREFORE, it is hereby resolved by the Borough Council of the Borough of South Plainfield that John Calvey is hereby appointed to the position of Senior Assessing Clerk, effective July 1, 2010 at a salary commensurate with the Borough’s salary ordinance

WHEREAS, with the retirement of the Assessor, the Assessing Department will make several adjustments in staffing to insure a smooth transition and continued effective performance; and   

WHEREAS, Gary Toth has agreed to return in a temporary, part time position of Chief Assistant Assessor to assist in the transition;

NOW, THEREFORE, it is hereby resolved by the Borough Council of the Borough of South Plainfield that Gary Toth is hereby appointed to the position of Chief Assistant Assessor effective August 1, 2010  through December 31, 2010 at a salary of $8,400.00.

Clerk Graf reported that the purging of old records from the basement storage yielded 4 tons of paper which was disposed of by Midco Waste.  She thanked Hall’s for the use of the truck during the process.  She also announced that effective July 1, 2010, the bid threshold will increase to $26,000.  She also asked for direction on a request from the Municipal Clerks Asso.of NJ regarding the cap on the Property Tax Levy.

Borough Engineer Len Miller reported that the New Market Ave resurfacing project went out to bid and the bid opening will be June 29th and award the bid at the special July 1st meeting.

Borough Attorney Paul Rizzo reported on Edison’s request to support a resolution on changing the property tax appeal process.  He conferred with our Tax Attorney, Marty Allen. there are parts of the bill he favors and others he doesn’t so he has asked for some time to prepare something for the Council.

Mr. Bengivenga reported progress.

Ms. Buteas reported that she and Mr. Cullen interviewed students for the intern program and have selected three interns – Janet Vallacruz, Richard Rotella and Jordon Davis.  She also read a thank you from the teachers at Grant School to the Cultural Arts Commission for their excellent American history freedom training program for the students.

Mr. McConville reported progress.

Mr. Rusnak reported that the Library Board has voted not to return the requested 10% of their surplus back to the borough.  He also thanked everyone for their participation in the budget meetings held last week.

Mr. Anesh commended Riley School for their “Walk for the Cure” which raised over $600 for breast cancer research.

Mayor Butrico reported that he attended a Shared Services meeting with the Middlesex County for an exploratory meeting to start the process.  He also mentioned that the Staff and Committee for the OLC Feast of St. Anthony sent a letter of appreciation to Mike Zushma and the OEM & CERT members who donated their time and assistance during the feast.

Mayor Butrico opened the meeting to the public.

Frank Mikorski commented on proposed action at last week’s BOE meeting regarding a raise for the Asst. Superintendent and Business Administrator, essentially to cover the upcoming 1.5% health insurance assessment.

Mayor Butrico closed the public portion and called for a motion to adjourn.  So moved by Mr. Bengivenga and seconded by Mr. Rusnak.
