Minutes from the July 1, 2010 Public Meeting                                    

of the South Plainfield Mayor and Council

 

The meeting was called to order at 6:00pm by Mayor Butrico in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-6, with adequate notice of this meeting of the Borough Council being provided to the borough’s two official newspapers and also published on the Borough’s website. 

Clerk Graf called the roll.  Present were Council Members: Anesh, Bengivenga, & Rusnak.

Council members Buteas, McConville and Salerno were unable to be in attendance.  Also present were Borough Engineer Len Miller, Borough Attorney Paul Rizzo and Borough Clerk Joann Graf.

Mr. Bengivenga offered the Invocation after the Pledge of Allegiance.

Mr. Anesh made a motion to table Ordinance # 1895 due to the lack of a two-thirds majority required to adopt a bond ordinance; seconded by Mr. Bengivenga and approved.

Mr. Bengivenga made a motion to table Resolution # 10-183 as it is a companion resolution to Ordinance # 1895; seconded by Mr. Rusnak and approved.

Clerk Graf read Ordinance # 1899 by title only for introduction as follows:

#1899 entitled:  An ordinance amending Chapter 187, Vehicles and Traffic, of the Code of

   the Borough of South Plainfield.

Mayor Butrico gave an explanation that purpose of this ordinance is to restrict left hand turns from McKinley St.

Mr. Anesh made a motion to approve Ordinance # 1899 on introduction; seconded by Mr. Bengivenga.

Mr. Bengivenga made a motion to approve Resolutions 182 and 184-187; seconded by Mr.Rusnak.

WHEREAS, in accordance with the provisions of N.J.S.A. 40A:11 any expenditure of public funds in excess of $21,000 requires the advertisement for proposals for delivery of said goods or services; and

WHEREAS, a need has been determined for the resurfacing of New Market Avenue from Elsie Ave to the South Clinton Ave extension; and

WHEREAS bids were solicited and opened on Tuesday, June 29, 2010 and the following companies submitted bids:

                                                              Top Line Construction          $374,882.90

                         AMC Industries                     $392,907.30

                         Stilo Excavating                    $417,724.95

                         Intercounty Paving                $457,470.00

WHEREAS, the bids have been reviewed by the Borough Engineer, T & M Associates, and it is the recommendation of the Borough Engineer  that the bid of Top Line Construction in the amount of $374,882.90 be accepted subject to a legal review and approval of the bid documents by the Borough Attorney, Paul Rizzo; and

WHEREAS, funds for said purpose have been certified by the Chief Financial Officer and are available from a 2010 NJ DOT Municipal Aid Grant subject to concurrence by the NJ Dept. of Transportation and approval of the NJ Dept. of Labor, Office of Wage and Hour Compliance

NOW, THEREFORE BE IT RESOLVED by the Governing Body of the Borough of South
Plainfield that authorization is hereby given to award a contract for the resurfacing of New Market Avenue to Top Line Construction at a cost not to exceed $374,882.90, pursuant to approval and concurrence by NJDOT and NJ Dept. of Labor.

FURTHER BE IT RESOLVED that, once approved by all parties, the Mayor and Municipal Clerk are hereby authorized to execute the necessary agreement with Top Line Construction, the apparent lowest responsible bidder for the project.

WHEREAS, N.J.S.A. 40a:4-19 Local Budget Act provides that where any contracts, commitments or payments are to be made prior to the final adoption of the budget, temporary appropriations should be made for the purposes and amounts required in the manner and time therein provided, and

WHEREAS, the date of this resolution is prior to the adoption of the CY2010 Budget, and

WHEREAS, the temporary budget set forth below does not exceed twenty six and one quarter percent of the total appropriations in the previous years budget (exclusive of any appropriations made for Debt Service, Capital Improvements Fund and Public Assistance).

NOW THEREFORE BE IT RESOLVED by the Governing Body of the Borough of South Plainfield that the temporary appropriations are hereby amended to add the following amounts and that a certified copy of this resolution be transmitted to the Chief Financial Officer.

#10-185

WHEREAS, the Borough of South Plainfield maintains a Inter-Local Services Agreement between the Borough and the County of Middlesex which permits the Borough access to the County’s Division of Archives and Records Management Center for the storage of records; and

WHEREAS, the current Inter-Local Agreement expires on July 1, 2010 and the Mayor and Council wish to renew the agreement for another 3 year period and continue to utilize the County’s facility and valuable services;

NOW, THEREFORE, the South Plainfield Borough Council hereby authorizes the Mayor and Municipal Clerk to execute the Inter-Local Services Agreement between the Borough of South Plainfield and Middlesex County Division of Archives and Records Management for the storage of Borough records at the State approved facility.

WHEREAS, the Borough requires preventative maintenance service on an annual basis for the nine (9) traffic signals and two (2) flashers; and

WHEREAS, a contract needs to be entered into to provide maintenance of the traffic signals and flashers for calendar year 2010; and

WHEREAS, JENELECTRIC, Inc., 631 Morris Ave, Springfield, NJ 07081 has been provided said service and has submitted a proposal to provide the required maintenance at a cost not to exceed $6,550.00; and

WHEREAS, it is the recommendation of the Traffic Safety Officer to award the maintenance contract to JENELECTRIC, Inc. at a cost not to exceed $6,550.00; and

WHEREAS funds have been certified by the Chief Financial Officer and are available in the CY2010 Road Repairs and Maintenance Budget;

NOW THEREFORE BE IT RESOLVED by the Governing Body of the Borough of South Plainfield that authorization is hereby given to renew a maintenance agreement with JENELECTRIC, Inc., 631 Morris Ave, Springfield, NJ 07081 to provide maintenance of the borough’s traffic signals and flashers for calendar year 2010 at a cost not to exceed $6,550.00 for 2010.

WHEREAS, a request was made by Gary Rohrer to hold a block party on Monday, September 6, 2010 on Randolph Avenue, from Front Street and in 100’, from 2:00pm7:00pm; and

WHEREAS, Police, Fire and Rescue Squad have been notified and given their approval. 

NOW THEREFORE BE IT RESOLVED by the Governing Body of the Borough of South Plainfield that permission to hold said block party is hereby granted; and

FURTHER BE IT RESOLVED that copies of this resolution be given to the Police Department, Fire Department, Rescue Squad, Department of Public Works, Emergency Management and the applicant.

Mr. Rusnak made a motion to approve the Bills List; seconded by Mr. Bengivenga as summarized below:

Mayor Butrico provided additional information on Resolution # 10-182, the awarding of the bid for the resurfacing of New Market Avenue. 

Mr. Anesh asked whether, under the circumstances, if Cherry Street might be added to the capital project given the current prices we have experienced this year.  The matter was discussed by the Council and Engineer.

Mr. Mikorski addressed the Council on the merits of bidding projects right now because of the favorable results thusfar.

Mr. Miller announced that the Bulky Waste pickup was advertised for bid and the bid opening will take place on September 2nd.

Mr. Rusnak asked Mr. Miller for a status on the New Market Ave extension project.

Ms. Graf asked for clarification on which roads the county is milling and paving – Clinton Ave or South Clinton Ave.  Mr. Miller will look into it.

Mr. Anesh made a motion to adjourn, seconded by Mr. Rusnak.
